This agreement is entered into by the student identified on the face of this application, (hereinafter referred to as the “Student”) and the Canadian School of Private Investigation and Security Ltd., (hereinafter referred to as “CSPIS”). The purpose of this agreement is to allow the “student” to participate in an online OR in-person personal development program offered by “CSPIS”. This contract outlines the full scope of the agreement between the “student” and “CSPIS” and replaces all other agreements, whether verbal or written, either expressed or implied. 2. “CSPIS” is a private career college registered and approved under the Private Career Colleges Act, 2005, however it is clearly understood and acknowledged that the course/program outlined by this contract is a non-vocational program and is not subject to the provisions of the Private Career Colleges Act, 2005. For recourse, the parties agree to be bound by the terms of the contract as outlined herein. 3. “CSPIS” will supply and service the program identified on the application accompanying this contract in accordance and the “student” will pay tuition costs as shown on the contract. Where a contracted course is to be taken electronically, the student shall be granted access to course content and materials electronically, and shall be considered enrolled at that time. For in-person courses, “CSPIS” reserves the right to change, cancel, reschedule or alter a class or class start date, or any portion of a class schedule at its sole discretion at any time, and that if “CSPIS” chooses to cancel, reschedule or alter a class, the “student” will have the option to withdraw from such altered or amended program subject to the refund provisions outlined herein. 4. Upon successful completion of online training, “CSPIS” will upload confirmation of the “student’s” course completion to Serco Canada Inc. (“Serco”) so that “Serco” can provide a Training Completion Number. The “student” understands that any other services which “CSPIS” may from time to time make available to the “student” are not governed by the terms of this agreement, including career counseling or employment assistance, and any such services may be provided to the “student” without prejudice or obligation on the part of “CSPIS” as a goodwill gesture only. 5. It is understood that a Security Guard and/or a Private Investigator in Ontario must be licensed to act as such, and licensing is an issue regulated by the Ministry of Community Safety and Correctional Services. Additionally, a Security Guard or Private Investigator must successfully pass a Ministry mandated Security Guard’s or Private Investigator’s examination, and that such examination requires that the applicant pay a separate fee to the examining authority. It is understood that tuition fees for this program do not include licensing or examination fees, and that “CSPIS” has no authority to grant or refuse a licence to any applicant. Furthermore, an applicant who has a criminal record may not be eligible to obtain a Security Guard’s or Private Investigator’s licence. “CSPIS” has no responsibility or obligation in the event that any individual is refused a Security Guard’s or Private Investigator’s licence due to a criminal conviction or for any other reasons including but not limited to failing to successfully challenge the Ministry exam. 6. It is understood that any action or conduct by the “student” which violates the moral integrity or ethical standards that might reasonably be expected from a “student” of career college, as determined solely by the school authority, may result in an immediate suspension or expulsion from school. In the event of expulsion from participation in an online program, the “student” will not to be entitled to any refund. 7. For online training, withdrawal provisions, fees, charges and refund procedures are as follows: As this is an online program, it is understood and acknowledged by the “student” that full tuition becomes due and payable immediately upon enrolment, and are not subject to the “student’s” full participation, completion or passing this online program. Accordingly, there are no withdrawal or refund provisions for enrolling in an online program as no withdrawal refund is provided. 10. For in-person learning training, tuition charges are applied when a student is registered for an in-person program and confirms his/her intention to commence training. Thereafter, should the “student” withdraw from this program at any time prior to the actual start date, the student will be entitled to a refund of full tuition paid less the portion of the fee identified as a “registration fee” and a further 30%. of tuition costs. Should the “student” withdraw at any time after the start date but before such time as one-third of the program has been provided, the student will be entitled to a pro-rated refund, which means “CSPIS” will provide the “student” with a refund of tuition fees paid, less the portion of the fee identified as a registration fee, along with 30% of tuition costs as well as a further portion of the fees for which a class has been supplied and serviced, regardless of whether “student” was in attendance. It is understood that notice of withdrawal must be provided in writing, delivered personally, by mail, or via fax. It is also understood that in the absence of proof to the contrary, the date on which the school acknowledges receipt of a notice of cancellation will be deemed to be the date of notification. 11. The “student” understands a private career college is prohibited by law from guaranteeing a position to any “student” or prospective “student”. 12.
